| 摘 要： | 为了有效地规制"第三者插足"行为,本文分析了"插足"的法律性质,提出其侵权的法律构成,并依照有损害必有救济的原则,探讨了受害方的损害赔偿请求权问题,也即"第三者"的侵权民事责任.
