乡土社会秩序形态与调解变迁

中国古代社会,法秩序之间的沟通依靠文化的整合,国家通过"权力的文化网络"实现对乡村社会的控制,教化式的调解达到了法秩序的沟通;在中国法律新传统中,国家通过"权力的组织网络"实现对乡村社会的控制,调解成为国家治理的手段;在当代中国法治化的进程中,调解的运作由于受国家权力的影响,仍然不符合法治的要求,对调解进行创造性的转化必须依照法治的标准。
