| 摘 要： | 修正后的《中华人民共和国刑事诉讼法》将被害人列为当事人,并且赋予其很多的诉讼权利,这是我国立法的一大进步。但在司法实践中,因种种原因,导致被害人享有的一些诉讼权利未能得到实现,从而使法律的执行打了折扣,也未能充分保障被害人的合法权益。

| Abstract: | The Revised Criminal Procedure Law of the People's Republic of China lists victims as litigants and endows them with abundant litigious rights, which is a great step in our nation's lawmaking . But in the actual judicial practice, for various reasons, some of the victim's litigious rights cannot be realized. This has made the law enforcement imperfect, and the realization of the victims' legal rights impossible. |
