网络空间隐私权保护探析

网络技术的迅猛发展给隐私权的保护带来了极大的冲击,与传统的隐私权相比,网络空间隐私权具有新的特点并且其侵权形式更加多样化,为此,对网络空间隐私权的含义和内容需要加以明确界定.世界各国目前对网络空间隐私权的保护主要有两种模式,一种是以美国为代表的行业自律模式,一种是以欧盟为代表的立法规制模式,两种模式,各有所长,值得借鉴.我国对网络空间隐私权保护基础薄弱,应借鉴发达国家立法,制定适合我国国情的网络空间隐私权的法律法规.

On Protection to Privacy in Internet Space

The rapid development of network technology brought great impact on privacy protection,Com- pared with the traditional privacy,privacy in cyberspace is the new characteristics,And,more diversified forms of infringement,so the meaning and content of privacy in cyberspace need to be clearly defined.Now there are two models of cyberspace privacy protection in the world.One as United States is representative of industry self -regulation mode,the other as European Union is represented by the model legislation system,both models, strengths,which is worth learning from.China on the protection of privacy in cyberspace has weak foundation, China should learn from developed countries legislation which suitable for China conditions and establish cyber- space privacy laws and regulations.
