附随义务的法理基础及其在义务群中的地位

附随义务是伴随着民法理念从追求形式正义转而追求实质正义，民事权利因顺从社会本位而受限制、民事义务因而扩张而逐渐发展起来的，虽然至今没有一个明晰的解释和定义，但却散见于各国立法和判例之中，从其肇源到正式法典化，已经有100多年的历史。在其背后是诚实信用和合同自由的衡平，正是二者的此长彼消，孕育了附随义务。而在现代合同关系中，义务已经演变成一个群落，这些不同的义务紧紧围绕在主给付义务的周围，基于诚信原则和对债权圆满实现关系的紧密程度，由近及远，这其中，毫无疑问，附随义务应该处于最外围，和主给付义务、从给付义务相比较，效力也最弱。
