On Correct Exercise of Right of Discretion in Police Administrative Enforcement of Law

The public security organ is the important administrative law enforcement agency in the country. As the important component of administrative power, the right of discretion is essential in modern administration. But its improper use will constitute a threat to the administrative legality. So based on administrative law enforcement's characteristics and the tendency of discretion right's expanding constantly, how to exercise correctly the right of discretion in administrative enforcement of law is the important subject to be researched and solved. This article tries to discuss the problems from controlling the legislation of right of discretion, perfecting police administrative law enforcement supervision systems, strengthening police administrative construction of law-enforcing ranks; improving law-executors' individual level of constitutionality.
