| 摘 要： | 军事征用作为国防动员的一项重要内容，已成为国防动员资源保障的主要手段。但是由于目前法律规定尚不清晰，致使我国学界对于军事征用概念的认识还存在较大分歧。通过对军事征用的目的、主体、对象和时机等方面的分析，可以更好地完善军事征用的理论，并在此基础上促进军事利益的实现，对相对人权益进行最大限度的保障。
