| 摘 要： | 中国现行法律深受德国法的影响,将中国和德国的立法进行比较有一定的现实意义。两国在刑事立法中对中止犯成立的时间范围、中止犯的立法类型、共同犯罪的中止、中止犯的刑事责任等四个方面的规定均有不同。德国刑法对中止犯的合理性规定值得我国立法参考与借鉴。

| Abstract: | The present laws of China are deeply influenced by the German Law.It is of certain realistic meaning to compare the two countries' legislation.In criminal legislation,the two countries differs from each other in four aspects as follows: the scope of the time for discontinued crime,legislation types of discontinued crime,discontinued crime among complicity,the criminal liability of discontinued crime.The reasonable points of the stipulation of discontinued crime in German's criminal law are worth consulting and using for reference. |
