| 摘 要： | 西方形式主义司法有其独特的文化成因,根源于实证主义法学,判例法、法典化及司法的困难促进了司法的形式主义。中外形式主义司法在解决纠纷中有着不同的作用机理,西方的形式主义对我国司法的改造有重大启示。
