对涉外贴牌加工商标侵权的探讨

贴牌加工是一种司空见惯的贸易方式,但其中涉及的知识产权问题却不容忽视。在首先限定了探讨的对象为涉外贴牌加工后,本文从实务角度出发,引出该问题在实践中的处理方式,并在总结理论与实务界对该问题的主要态度的前提下,从商标使用、商标侵权之实质认定标准和利益衡平的角度重新认识和探讨了该问题,以期对实践中该问题的处理有所帮助。

The Discussion on Trademark Infringement in Foreign OEM

Nowadays,being a common mode of trade,OEM（Original Equipment Manufacturer） has been involved in many Intellectual Property issues which can not be ignored.After defining the foreign OEM as the object of study of this article,the author,from a practical angle,indicated the different treatments of such matter.Finally,on the base of concluding the main attitudes towards this matter both in theory and in practice,the author rediscovered and reexamined the problem from the aspects of use of trademarks,the substantive standard of trademark infringement and the balance of interests,expecting to be helpful for the solution of this problem in practice.
