犯罪故意类型新论

本文对于犯罪故意的类型 ,进行了系统的新探讨 :(一 )首次提出了行为故意和结果故意的分类法 ,进而将结果故意划分为直接故意和间接故意、确定故意和不确定故意、实害故意和危险故意 ;(二 )首次提出容忍故意的概念 ,将间接故意划分为容忍故意和放任故意 ;(三 )赞同将故意分为目的故意和非目的故意、预谋故意和非预谋故意、作为故意和不作为故意 ;不赞同积极故意和消极故意、无条件的故意和附条件的故意、事前故意和事后故意等分类法

On the Types of Criminal Intention

In this paper the author systematically discusses the types of criminal intention. First, he thinks that the criminal intention can be classified into behavior intention and result intention. Result intention can be further divided into direct intention and indirect intention, determined intention and undetermined intention, actual harmful intent and dangerous intent. Second, he puts forward the concept of tolerate intention and divided indirect intention into tolerate intention and noninterference intention. The author agrees that the intention should be divided into premeditated intent and non-premeditated intent, commission intent and omission intent, target intent and non-target intent. But he disagrees that the intention should be divided into active intention and negative intention, unconditional intention and conditional intention, intent before the event and intent after the event.
