| 摘 要： | 目前,对于非法证据排除规则,学术界主要是从实体层面进行了大量研究,而忽略了非法证据排除规则的程序问题。考察国外关于非法证据排除规则的操作程序,有美国的审前动议、英国的审判之中的审判式、日本的声明异议式、俄罗斯的庭前听证等四种模式。这四种模式通过程序性裁判活动值得借鉴,有助于我国非法证据排除规则的真正实现。

| Abstract: | Academic circles have had a lot of research on the Rule of Removing Illicit Evidence in terms of substance.However,the procedural issues of it are ignored.There are 4 procedural models to remove illicit evidences respectively from the US,the UK,Japan and Russia.The four models identify the weight of proof through some procedures.We can learn a lot from the models to remove illicit evidences in China. |
