抗拒抓捕还是逆防卫——从齐某抢劫案说开去

本文以齐某抢劫案为切入点，对于实施盗窃时以暴力抗拒抓捕而转化为抢劫罪这一规定进行反思。认为抗拒抓捕中的“抓捕”之暴力必须以制服犯罪嫌疑人为限度，如果是为了过度伤害犯罪嫌疑人的“抓捕”，犯罪嫌疑人可以进行反抗。进而对逆防卫行为的刑法正当性进行深入分析，用法律的利益平稳原理来确立逆防卫行为的正当性，并提出逆防卫制度设立的可行性，最后，用逆防卫理论来分析齐某抢劫案的定性。
