关于完善我国违宪审查制度的思考

完善我国的违宪审查制度是实现依法治国和保障宪法有效实施的需要。我国目前的违宪审查制度仅停留在原则层次上 ,并且存在着审查主体多元 ,违宪审查权虚置及缺乏审查启动机制、诉讼程序等诸多缺陷。完善我国的违宪审查制度应从完善违宪审查的主体、程序及审查方式等方面入手。

It is of great necessity for us to perfect the system of examining the activities against constitution in order to administer our country by law and carry out the constitution effectively. At present, this system in China remains in a low level with quite a lot of problems, such as more than one executive body, the right of examination existing in name only, the lack of starting mechanism and procedure of lawsuit. Perfecting the system of examining the activities against constitution in China should begin from clearly defining the executive body, improving the procedure and method of examination.
