论平衡原则与侦查程序

从国家追究犯罪效果角度观察我国刑事诉讼程序，侦查程序毫无疑问是整个程序的中心和重心，但由于侦查往往伴随着强制力的行使，因此侦查阶段便成了控制犯罪与保障人权最易发生冲突的阶段。在学界对人权保障问题的研究热潮即将退去之时，笔者通过借鉴宪法和行政法领域的平衡原则（比例原则），探讨其在侦查程序中确立的必要性和基本要求，以引起学界的再讨论，以期为完善我国侦查程序制度做出应有的贡献。

On the Principle of Balance and Investigation Proceeding

From the perspective of effect of the criminal punished by the state,investigation proceeding is undoubtedly the center and emphasis in China's criminal proceeding,however,investigation is always accompanied by enforcement, therefore,there are many conflicts emerging in the proceeding involving controlling the criminals and protecting their human right.In order to make some contribution to the improvement of our investigation proceeding,the author put forward the principle of balance that always employed in constitutional law and administrative law fields and discuss the necessity and its basic requirement in investigation proceedings.
