| 摘 要： | 农地发展权的建立将在一定程度上达到保护耕地、农民利益及生态环境等社会公共利益的作用，但我国缺失农地发展权制度。文章通过现行的土地法律制度和政策，分析了我国农地发展权缺失的表现、后果及原因，并探讨了建构的思路。

| Abstract: | The establishment of the agricultural land right to development will be to some extent to protect the arable land, the interests of farmers and the natural environment. Chinese law is short of agricultural land right to development. In this paper, author analyze reasons and consequences for the missing in the existing system of land law and policy, and explore the construct of thought. |
