专家辅助人制度基本问题研究——以《刑事诉讼法》第192条规定为切入点

新《刑事诉讼法》第192条创设了专家辅助人制度,这是鉴定制度改革的一大亮点。但该条规定过于粗疏,缺乏可操作性,实践中需要对专家辅助人的诉讼地位、资格条件、中立客观义务、虚假陈述的法律责任、质证范畴以及申请出庭决定程序等基本问题进行研究,并细化完善该项初生制度。同时,应基于系统观念,推进相关配套制度建设,当下尤其是应继续深化司法鉴定制度改革、加快鉴定人及专家辅助人信息库建设以及制定规范化的刑事鉴定意见质证规则,惟此方能实现该制度的立法目的。

On the Basis Issues concerning the Expert Assistant System： Starting from Article 192 of the Criminal Procedure Law

The Article 192 of the new criminal procedure law established the expert assistant system, which is a breakthrough of the reform of the verification system. However, this article is to brief to be manipulated. In practice, some basis questions shall be resolved, such as, the status in litigation, prerequisites and objective obligation of the expert assistant. Besides, the legal liability of false statement, the scope of cross-examination, and the decision procedure of applying for entering in court are also questions need to be studied, moreover, the system need to be improved in details as well. At the same time, the supporting system shall be established in a comprehensive way. At present, the reform of judicial authentication system shall be further carried on, the establishment of the information base of appraiser and expert assistant shall be accelerated, and the cross- examination of the criminal expert evaluation shall be normalized. Only in this way, can the purpose of establis- hing this system can be achieved.
