| 摘 要： | 在我国,契约型基金所有权归属有不同观点如“双重所有权说”、“独立财产说”和“投资人所有说”等。从管理人和托管人的权利来源及投资人享有权利性质来看,该文认为基金财产应属投资人所有。但法律对该财产进行了特殊设计,使其具有不同于一般财产的特性。
