论鉴定结论的认证

鉴定结论是法定的诉讼证据种类之一,在司法实践中,鉴定结论往往发挥着关键性的证明作用。然而,鉴定结论本身也存在一些问题并影响了该类证据的可靠性。因此,对鉴定结论的审查判断就显得十分重要。笔者认为:在对证据的认证上,证据资格问题应制定详细证据规则;对证据的可采性问题实行法定主义;证明效力问题应给予法官充分的自由裁量权;因鉴定结论本身固有的特殊性,在认证规则上亦有所不同。

On Identification of Expert's Conclusion

Expert's conclusion usually plays a vital play in judicial practice as legal evidence.However,expert's conclusion maybe makes the kind of evidence incredible because of some problems itself.Therefore,it is important to examine and judge evidence.The author gives the following suggestions: detail rules should be designed on competence of evidence;articles of admissibility of evidence should be stipulated in law;discretion right should be endowed with the judges on effect of evidence;some special regulations should be drawn up on the identification of evidence due to the characteristics of expert's conclusion.
