| 摘 要： | 自 1997年修订的《中华人民共和国刑法》施行以来 ,非国有事业单位、非人民团体性质的社会团体存在着严重的受贿问题 ,由于没有相应的条款规定 ,尚难追究受贿人的刑事责任 ,已成为全社会反响强烈的热点问题。文章围绕业务人员受贿罪设立的必要性、可行性及行贿罪的设立构想 ,提出粗浅建议 ,以便理顺我国现行刑法贿赂犯罪体系。

| Abstract: | Since the implementing of the amended "Criminal Law of PRC", there has been a serious problem of bribery in non-state owned enterprises and institutions, non-people groups, it's difficult to charge their criminal responsibilities without the corresponding regulations, which has become the hot issue stirred in the society. The essay proposes some ideas centered on the necessity of setting up partitioner bribery crime so as to perfect current bribery crime system in the criminal law. |
