| 摘 要： | 集体协商代表权的问题是决定集体协商成效的基础性问题,现实生活中已逐渐凸显因集体协商代表权相关法律制度的欠缺而导致的诸多协商困境.因此,有必要理顺代表权产生的法理基础,重新构建代表权法律制度,解决因代表权而产生的异议与纠纷.
