| 摘 要： | 非法经营罪从1979年刑法所规定的投机倒把罪中分解出来,成为一个独立的新罪名。该罪的客观特征和司法认定中的“情节严重”等多个问题均值得进一步分析与探讨,这利于深刻理解法条精义与准确适用法律。

| Abstract: | Illegal business operation was separated as a new type of crime from speculative crimes in 1979' s criminal law. Its objective characteristics and "gravity of the circumstances" as well as other issues in judicial determination need to be further analyzed and discussed, which will be helpful to fully understand its legal interpretation and apply it properly to the law. |
