论行政裁量权的程序控制

行政裁量权的程序控制，是指通过制定严格而科学的行政程序，规范行政主体行使行政权的步骤、方式、时间和时限，将行政权的行使置于广大人民群众的监督制约之下，从而有效地促使行政机关依法行使行政权，尽量减少行政裁量权的滥用现象。在程序上控制行政裁量权，至少应构建或完善以下程序制度：信息公开制度、回避制度、案例指导及联网制度、告知并说明理由制度、行政教导制度、行政机关内部监督制度。
