| 摘 要： | 近五百年前,中国文化遭遇西方文化从而发生巨大的全方位裂变,其中作为中国文化之核心的中国学术之裂变最为剧烈。中国学术艰难地发生着转型,从传统迈向现代,走过了漫长的路程,虽然这一过程今天尚未完全结束,但从总体上看则处于一个逻辑的终结点上。今天中国的知识人承担着这样的学术使命,自觉地终结这五百年的文化发展逻辑,合乎逻辑地创造出中国现代学术的知识类型。中国学术走过了子学阶段、经学阶段和理学阶段,今天则合乎逻辑地过渡到法学阶段。不同时代的知识类型必有与之相适应的哲学观念为之奠基,作为今天中国学术新阶段的法学知识而言,其哲学观念必是与现代性相伴而生的,新道统论作为一种当代中国法哲学样式正是为这种法学知识奠基的。
