社会管理创新法治化的基本问题研究

从词源学角度看,社会管理是一项重要的国家管理职能,其核心是公权力的运用,其根本目的在于公共利益。故而社会管理的核心是公权力的运用,当属于公法领域的问题,而进一步从权力的属性角度分析,社会管理实质上更多地属于行政权的运用问题,故社会管理及其创新应当接受法律的统制。换言之,必须坚守法治主义精神,应先通过法定程序对既有法律作出修改,尔后再行创新之举。

Research on Basic Problems of Legalization in Social Management Innovation

The social management, from the per spective of etymology, is an important national management, which emphasizes the use of public power and set its fundamental purposes for the public interests. So the core of the social management is the public power involved in the field of public law. From the further analysis of its power attribution, the social management essentially belongs to administrative power, that＇s to say, the social management and its innovation should be defined by the law. In another words, we must stick to the rule of law, modify it through legal procedures and improve it.
