论行政诉讼参加类型的架构

既有的行政诉讼第三人制度架构简陋,设计过于肤浅;相应的理论研究则侧重于第三人发现,忽略了不同第三人的权利差异。借鉴大陆法系的分类技术,引入诉讼参加概念,以必要诉讼参加、普通诉讼参加和行政机关辅助参加重构诉讼参加类型,把各种形态下能够参加诉讼的第三人种类予以覆盖,能够较好地把握不同诉讼参加人的特质,拓宽权利救济渠道。

On Categories of Participants in Administrative Litigation

The existed system of the third party is too simple to note the different rights of different ones, with all theories emphasizing particularly on the discovery of third party. Learning from the concept of litigation participants in continental law system, we could reconstruct it in aspects of necessary joint action participants, common joint action participants and administrative organ assistant participants. So all kinds of “third party” can be covered, which makes remedies more adequate.
