刑事申诉检察及其法律监督功效

刑事申诉检察工作是检察机关履行法律监督职能的重要体现，也是维护司法公正的重要手段，其对强化检察工作的内部监督和制约、规范检察权的行使、保障群众切身利益具有极其重要的作用。2013年1月至11月，全国检察机关依法纠正原刑事处理决定确有错误的申诉300多件，提出抗诉近90件，监督法院再审改判或发回重审320余件。通过一手抓自身办案，一手抓办案指导，推行刑事申诉权利告知和风险提示、刑事申诉案件公开审查等制度，刑事申诉办案工作不断深入健康开展。这既有效化解了社会矛盾，增强了司法亲和力和公信力，也切实保障了人民群众的申诉权利，有助於减少、避免冤假错案。十八届三中全会以来，涉法涉诉信访工作机制改革的推进为刑事申诉检察工作的发展提出了挑战，亦提供了机遇。本期特选取最高人民检察院罗庆柬副厅长的文章，解读刑事申诉检察的地位和作用，阐述其在防范冤假错案、防治司法腐败申的成功经验与做法。

Procuratorial Work of Criminal Appeals and Its Legal Supervision Efficacy

According to China＇s Constitution and laws, the People＇s Procuratorates are state organs for legal supervision. They perform various important duties of ratifying and deciding arrestment, of presenting public prosecution, of investigating duty crime cases like corruption, bribery and dereliction, and of conducting legal supervision over litigation activities according to law. The procuratorate organs＇ procuratorial work of criminal appeals fully disglays their functions of legal supervision, but due to its nature of post-supervision and its limitation of supervision means, it hasn＇t received ample public attention yet. With the ever-greater efforts devoted to the legal supervision of the procuratorate organs, especially efforts in correcting and preventing cases in which people were unjustly, falsely, or wrongly charged or sentenced, the status and efficacy of the procuratorial work of criminal appeals are becoming increasingly prominent. This paper will explore this from the following three aspects.
