宪法适用应依循宪法本身规定的路径

我国宪法适用主要应该走最高国家权力机关立法适用和监督适用的路径。宪法适用"司法化"的路径悖离现行宪法,行不通。现行宪法从来没有任何规定曾由司法机关作为裁判依据合法地适用过。如果一定要说我国有"宪法司法化"的案例,那也只能作为个别法院违宪违法的证据,不应成为其他法院效法的榜样。一些法律、法学界人士对"宪法司法化"的渲染是非理性的。应当以现行宪法为基础确立理性的宪法适用观念。鼓励"宪法司法化"不仅无助于促进宪法适用,还会妨碍我国宪法适用体制的完善和宪法适用效能的提升。法院审理案件援引宪法与"宪法司法化"没有必然联系,而法院审理案件未援引宪法也并不表明其行为一定不具有"宪法司法化"性质。对于法院援引宪法应根据不同情况区别对待。消解"宪法司法化"的关键在于强化宪法立法适用,落实宪法监督适用。

Constitution's Application should Follows the Road Stipulated by Constitution Itself

The application of constitution in China should be mainly carried out in the ways of legisla- tion application and supervision application by the highest state power organ.The way of"judicial applica- tion"in constitution application is not in accordance with the current constitution and won't work.There is never any stipulation in current constitution that has been applied legally as the basis of decision by the judi- cial organs.If someone insists that there are the cases of"judicial application of constitution"in China,the cases should be regarded as the evidences of a few courts'violating the constitution and law and should not be the examples followed by the other courts.We should establish the reasonable concepts of constitution application based on the current constitution.Encouraging the"judicial application of constitution"is no help for promoting the application of constitution.What's more,it hinders the perfection of the system of constitution application and the increase of the efficiency of constitution application in China.There are no necessary relations between the citation of constitution in the court's hearing and the"judicial application of constitution".As for the court's citation of constitution,we should treat differently according to different situation.
