| 摘 要： | 关于居住权，我国学者早有论述，但我国民法中却没有规定居住权制度。居住权是居住人对他人所有的住房以及其他附着物所享有的占有、使用乃至收益的权利，是为了特定人的利益而设定的用益物权，具有无偿性、长期性或终身性。居住权制度主要包括老人的居住权和离婚妇女的居住权。基于这两种人群在经济上的弱势地位，为了保障其基本生活，有必要设立居住权制度。

| Abstract: | The fight to reside is the right which is held and used by the inhabitant. The institution of right to reside mainly indudes the right to reside for the aged and the fight to reside for the divorced women. It is necessary to establish the institution of right to reside to ensure their basic living for their worse economic conditions. |
