论国家侵权精神损害赔偿

国家侵权精神损害是指因国家侵权损害自然人的人身权,致使其精神活动出现障碍而产生的身体上和精神上的痛苦。我国《国家赔偿法》应建立国家侵权精神损害赔偿制度;国家侵权精神损害赔偿的范围应当包括物质性人格权侵害的赔偿和精神性人格权侵害的赔偿;赔偿请求权人仅限于受到精神损害的自然人,不包括法人和其他组织;国家侵权精神损害赔偿应确立"金钱赔偿为主,精神补救为辅"的原则,算定精神抚慰金时应兼采"不同损害不同赔偿"和最高赔偿限额两种方法。

On the Compensation for Spiritual Damage Owing to Right-Tortious by State

The spiritual damage of right-tortious by State means the physical and the spiritual suffering brought by the obstacle of spiritual activity, due to the right-tortious by state has done harm to personal right of the natural person. The State Compensation Law in our country should set up the compensation system of right-tortious by state for spiritual damage. The range of compensation for spiritual damage should include compensation for the encroachment on materialized right of personality and spiritual right of personality. The compensation claim for spiritual damage should only limit to the natural person, excluding the legal person and other organizations. The compensation for spiritual damage should establish the principle of "give priority to the money compensation, and spiritual remedy as the complement". In the meantime, when calculating the compensation for spiritual conciliation, it should adopt two kinds of methods, including the method of "different damages for different compensation" and the method of compensation ceiling.
