社会变迁中的社会保险争议处理体制

权利救济体制是一个动态的历史范畴,因而很有必要从社会变迁的视角对我国现行社会保险争议处理体制进行研究。新中国成立以来,我国社会保险制度变迁呈现出一个保险社会化的过程。与此同时,社会保险争议的社会性也在不断增强,社会保险争议主体逐渐多元化,社会保险争议的内容也更加复杂化。我国现行社会保险争议处理体制的主要缺陷就是不能反映和有效应对社会保险争议社会化这一现状,因此有必要从理念上进行超越、在体制上进行重构。

The Dispute Processing System of Social Insurance with Social Change

Since the right remedy system is of a dynamic historic category, it is suggested to study the cur- rent social insurance dispute processing system from the perspective of social change. The social insurance sys- tem upon the founding of the People5 Republic of China has evolved in a socialization process, as the sociality of social insurance disputes has enhanced correspondingly with increasingly diversified dispute subjects and more complicated disputes content. With regard to the major flaw that the current social dispute processing sys- tem cannot reflect and respond to the socialization of social insurance, it is necessary to reconstruct the social insurance dispute processing system from both conceptual and systemic levels.
