公安信访听证程序研究

2005年1月国务院常务会议通过的新信访条例在办理、复核程序中引入了听证程序,这为信访人提供了公证、合理的程序保障,同时又增强了行政决策、决定过程的透明度以及最终处理结果的社会认同度,在客观上也给公安机关信访工作提出了新的课题。在新的信访条例框架下,对听证程序的法律渊源、立法轨迹、功能价值和基本原则进行分析,结合公安信访工作的实践,提出了完整的公安信访听证程序的制度构建与相关问题的解决途径。

Research on the Public Security Hearing Procedure in Letters and Visits
