论政府决策的责任追究

当前 ,政府决策尚未建立起有效的责任追究制。政府决策责任追究的前提是对责任的认定 ,责任认定的根本标准是政策决策是否损害了公民的合法权益 ,而责任追究的有效途径是将政府决策行为纳入行政复议、行政诉讼和司法监督制约范围之内。

On the Responsibility-ascertained System of Governmental Policy-making Behavior

Since governmental policy-making behavior is a political process of exercising public power for seeking public interests, it behooves government to follow the principle that the power must be consistent with responsibility. In order to live up to the principle, government should set up responsibility-ascertained system whose prerequisite affirms the existence of governmental policy-making responsibility. An important responsibility-affirmed criterion is based on whether governmental decision possibly does do harms to the public interests, and an effective responsibility-ascertained way is to have governmental policy-making behavior restricted within the range of administrative re-discussion, administrative lawsuit and judicial supervision.
