论政府监管体制的现状及改革思路

政府监管是解决和矫正市场失灵问题的有效手段。现行监管体制存在的主要弊端一是监管主体的合法性缺失,二是监管体制不畅,为此,应健全监管法律体系,加强行政组织法的立法活动,从根本上抑制权力的失控。建立完善的行政程序制度和外部监督机制。深化政府机构改革,建立归属于国务院直接领导的监管机构,加强监管机构的权威性和独立性,真正实现对市场主体的调控功能。

On Government Surveillance System and Its Reform

the government surveillance is an effective way to resolve and correct the market malfunction.The main limitations of current system include lacking of legitimacy on supervision body and un-flowing supervision system.We should perfect the legal surveillance system,strengthen legislation on administrative organization law,and,control the power abuse from the foundation.We should set up the complete supervision system and administrative procedures system,further the government reform,build up the supervision organization directly led by the State Department,strengthen the authority and independence of these organizations and realize the adjusting and control function.
