| 摘 要： | 民事权利能力和民事行为能力是民事法学理论的基本概念,其地位已然由历史决定。但基于法人权利能力和行为能力性质而产生的对两种能力的范围及一致性问题的探讨观点不一。法人的民事权利能力和行为能力在时间和范围上具有一致性。
