法治视野下讯问场所的规制

要实现《刑事诉讼法》再修改①的初衷,在保障人权与打击犯罪的双重价值中寻求到一个平衡点,就要求在立法上做到侦查程序设计的公正性与合理性。具体到侦查讯问,需要避免讯问权失范的现象。刑讯逼供行为总是发生在特定的时空环境内,所以,在侦查讯问程序设计中,对讯问场所的设计尤为重要,应通过讯问场所的规范化来消解讯问权的滥用,并配合相应的外部监督机制,切实做好对讯问活动的监督工作。
