| 摘 要： | 为预防和惩罚婚内的侵权行为,使当事人在婚姻关系存续期间就能获得及时救济,应当设立婚内侵权损害赔偿制度。这不仅符合我国婚姻立法的精神,而且可以更好调整夫妻之间的关系,维护家庭稳定和社会和谐。
