| 摘 要： | 从理论依据、构成要件和法律效力上看,不动产亦可适用善意取得制度。可适用善意取得的不动产包括部分共同共有人擅自处分已登记的、有登记瑕疵的、尚未进行登记但不违章的以及已登记的属赃物的不动产。

| Abstract: | The bona fide acquisition system can also be applied to real estate in consideration of theoretical basis, component key items and legal effect. The scope of applicable estate involves the registered at part owner's disposal without permission, the registered with flaws, the unregistered without illegality and the registered but belonging to loot. |
