论我国行政诉讼受案范围的局限性及其改进

我国现行行政诉讼受案范围过于窄小,已不能适应时代的发展变化,如受案范围的确定方式有漏洞,对合法权益的保护范围过窄,所针对的被诉行政行为极其有限等等。这些都需加以改进:一是在确定受案范围的方式上,应以概括的方式对受案范围作总体规定后,只对不受理的事项明确列举加以限制,未列举的则全属应受案的范围,使之最大限度地拓展可诉案件的容量。二是将受案范围从仅涉及公民一方人身权、财产权的案件扩大到保护各种合法权益的案件。三是突破目前受案范围只针对部分外部具体行政行为的局限,将规章以下的规范性文件、涉及初任公务员的考试录用、解聘、辞退、开除公务员身份的决定等都纳入受案范围。

On Limitation and Improvement of Case Accepting Scope of Administrative Litigation in China

The too narrow scope of current administrative litigation case accepting can not afford the development and changes of the times, eg. there are loopholes in the determining method of the case accepting scope, the protection scope of legal interests is too narrow, and the types of administrative behaviors can be sued are few, etc. Three pieces of suggestion are put forward. Firstly, as for the determining method of the case accepting scope, after summarizing the general regulations, all conditions should be accepted except several specific ones which should be listed clearly in order to expand the case accepting capacity in maximum. Secondly, interests counted should be expanded from only personal and property rights concerning citizens to all types of rights. Thirdly, the current limited scope of part of external specific administrative behaviors only should be broken through to take in to inclusion of all normative documents below the rule level and decisions related to newly appointed civil servants, such as the examination and the dismissal, etc.
