污染受害者的物权法保护

对污染受害者的权益保护仅仅用侵权行为法救济而忽视物权保护方法,必然导致物权保护的缺位或者对物权采用侵权法保护而放弃更有利于污染受害者的物权保护。土地资源、水资源和部分能直接带来收益的财产如建筑物可以通过物权请求权予以保护。建立独立的物权请求权较之侵权请求权对污染受害者更为有利。

Jus Rerem Protection for Pollution Victims

The protection for the pollution victims only through torts law while neglecting its jus rerem protection will result in the lack of jus rerem protection,or giving up the jus rerem protection,which is in favor of the pollution victims.Land resource,water resource and some properties that can produce direct incomes,such as constructions,can be protected through the right of real claim.To establish separate right of real claim is more favorable for the pollution victims than the right of tortus claim.
