| 摘 要： | 刑事诉讼法对羁押必要性的审查方式和审查内容无具体规定。在理论上对羁押必要性审查机制进行针对研究,以更好地指导司法实践具有重要意义。羁押必要性的审查方式包括书面审查、听取意见审查和听证审查三种。羁押必要性审查的内容主要包括逮捕条件是否具备和是否妨碍诉讼的顺利进行两个方面。

| Abstract: | In Criminal Procedure. Law, there ＇ re not specific regulations on the review form and contents of detention necessity. A theoretical research on the review mechanism of detention necessity will have great importance in guiding judicial practice. The review form of detention necessity includes paper review, listening review and hearing review; the review contents of detention necessity mainly includes two aspects： if there exists the arrest condition and if the procedure will be hindered. |
