| 摘 要： | 立法赔偿作为国家赔偿的一个重要组成部分，一直为学者们所重视。但目前世界上将立法赔偿纳入国家赔偿范围的国家并不多。在借鉴法国、德国等国家立法赔偿制度的基础上，我们应构建有中国特色的立法赔偿制度。
