| 摘 要： | 证人出庭作证是现代诉讼制度的要求，但是在特定条件下也赋予了证人可以拒绝作证的权利，这一权利是现代法治国家对证人作证义务的一种法定免除。两大法系国家普遍规定了证人在特定情形下享有拒证权，但我国目前没有一部法律承认证人有拒证的权利。如何在权衡利弊的基础上建立我国的证人拒证权制度，是需要我们进一步研究的问题。
