| 摘 要： | 《道与中国法律传统》意在检讨道与中国法文化之间的关联:道,乃中国文化传统的支点;而中国传统的法律则被包裹在礼的“玄想”当中。道,为礼与法提供了一个最高范畴和绝对价值;同时,道又通过道法、道术等各种渠道层层渗透进中国法律传统之中。

| Abstract: | Tao and Chinese Legal Tradition by Dr. Long Da - xuan is devoted to the study of the relations of Tao and the Chinese traditional law. According to Mr. Long,Tao (virtue), the fulcrum of Chinese cultural tradition, provides a classic paradigm and an absolute value for traditional law, clad in Confucian Li(civility). Moreover, Tao transfers itself into Chinese legal tradition through Taofa, Taoshu. This paper makes comments on these views and raises several relevant problems. |
