| 摘 要： | 目前居住小区地下停车库一般以3种方式存在,小区地下停车库的问题主要是其产权问题。居住小区地下停车库的产权不明问题的根源在于我国地下空间权的缺失。当前,我国地下空间权的建立具有可行性:地下空间权已具备作为一项权利的因素;地下空间具备权利客体的特征。

| Abstract: | At present,there are mainly three kinds of underground garage in residence zone.The problem of underground garage in residence zone actually is the problem of its property.The problem of lacking of clarity of underground garage results from the missing of the right of underground space.At the moment,it's of feasibility to establish the right of underground space as the right has already possessed the factors and object characteristics of a right. |
