假释监督保护机构及人员之比较研究

在不同的法律文化和立法背景下,各国对假释罪犯监督保护的机构和人员存在很大的不同.我国现行立法规定假释罪犯的监督保护由警察机关实施,这是不合理的,应由假释委员会承担对假释犯的监督保护责任.对我国假释犯监督管理机构改革应遵循"专门机构主导,社会力量配合"的原则进行.

Comparative Study on Institution and Members of Parole Supervision and Protection

On different background of culture of law and legislation,there is very difference in institution and members of supervi-sion and protection to parolee in different countries.It is unreasonable that police station carry on the supervision and protection to parolee in our legislation.It should be the parole committee to take the responsibility of supervising and protecting the parolee.Our reform on institution of supervision and protection to parolee should abide by the principle of special institution guiding and social factor assisiting.
