人权视角下的毒品问题

毒品"合法化"是指滥用毒品的非犯罪化,这实质上是主张使非医疗和科研用途的毒品成为合法商品,通过合法经营和买卖,降低其暴利,减少禁毒成本,实现滥用毒品非罪化,从而试图减少毒品的社会危害,把禁毒的希望寄托在公众自我的约束和觉醒上.此观点的理论依据主要是禁毒无效论和减少危害论.对滥用毒品合法化我国禁毒决策部门应当有全面的理解,高度重视其现实危害性,切实采取措施,把矫治、预防和打击相结合,避免其对禁毒工作的负面影响和冲击.

Drug Problems under the Perspective of Human Rights

Drug"legalization"means decriminalization of drug abuse.It suggests decrease the cost of ant- drug activity and drug profit by commercializing drug through legal trading in non-medical and non technology usages,and at last decreases the social threat of drug.This opinion prevailed in some heavily drug consuming countries in America and Europe and other drug producing countries.Its main theoretical basis is failure of drug ban and reducing drug threat by legalizing it.The decision makers in China should pay attention to this opinion through some proper methods and prevent the negative impact of this view on practical anti-drug policies.
