| 摘 要： | 与欺骗性的非法行医行为相比,自愿交易型非法行医行为的人身危险性和客观危害性均小得多,而且其可罚的公众基础具有减弱性。因此,自愿交易型非法行医行为具有特殊性,应该单独作为非法行医罪的一个条款加以规定,并应坚持刑罚的谦抑性原则,从轻处罚。

| Abstract: | Compare to deceptive conduct of illegal medical practice,the voluntary conduct of illegal medical practice is less harmful in personal dangerousness and objective aspect.Meanwhile,the public basis of penalty is weaker.As a result,a voluntary con-duct of illegal medical practice is of specialty and it should be regulated as a separate clause of illegal medical practice crime.Regard-ing to the principle of Ultima Ratio of Penalty,this action should have a lighter punishment. |
