全球化背景下完善我国商业秘密法律保护之构想

为应对经济全球化的挑战 ,必须在保留我国现行的商业秘密法律界定的基础上 ,着力修改完善我国关于商业秘密犯罪的刑法规定。为此 ,首先应当完善商业秘密犯罪的罪名体系 ;其次 ,严格限制侵犯商业秘密罪的犯罪构成 ,将侵犯商业秘密犯罪的主观罪过全部限定为故意 ;再次 ,对侵犯商业秘密犯罪的法定刑增设多个量刑档次 ,以使侵犯商业秘密犯罪的法定刑设置宽严相济 ;最后 ,规定对于一般的侵犯商业秘密犯罪 ,须“告诉才处理” ,但是 ,侵犯商业秘密危及国家利益或者情节严重的则除外。当然 ,关于这一问题的根本解决 ,关键还在于《商业秘密保护法》的制定。

A Plan to Perfect China's Protection of the Law of Business Secrets under the Globalization Background

On the base of maintaining the definition of business secret of our nation's law, we should revise our criminal's stipulation on the crime of business secrets in order to meet the challenge of economic globalization. Therefore, we should firstly perfect our accusation system on the crime of business secret ; secondly, we should limit strictly the constitution of the business secret crime; thirdly, we should enlarge the scope of the business secret crime's statutory sentence; fourthly, we should stimulate business secret crime as no trial without complaint. Nevertheless, some cases should be excluded such as violating business secret endangered the nation's benefit or when the case is of gross violation. To draw up Protection Law on Business Secret is the basic approach to resolve the problem.
