| Abstract: | The originality of technology is the fundamental premise for the people to gain the patent protects.The standard of originality is the state＇s foundation stone of patent legal system.The amended Patent Law formulates that the originality standard should be used in China.And originality standard also is the fundamental means for the state to adjust individual benefit and public benefit. |
